Esfera is a spatial-audio streaming platform operated by South Loop Studios Limited (“we”, “us”, or “our”), a company registered in England and Wales (company number 16933824, registered office 38 South Loop Park, Birmingham, B16 0AF, United Kingdom; VAT number GB511185230). By creating an account or using Esfera, you agree to these Terms of Service.
1. Accounts
You must provide accurate information when creating an account and keep your credentials secure. You are responsible for activity on your account. We may suspend or terminate accounts that breach these Terms.
2. Your Content
Esfera lets you upload, publish, and share audio, artwork, and profile information (“Your Content”).
- You retain ownership of Your Content.
- You grant us the licence needed to operate the platform: to host, store, transcode (including spatial rendering), distribute, and display Your Content to the audiences you choose.
- You are responsible for having every right needed to publish what you upload — including recording, composition, and performance rights.
- We may remove content that infringes rights, breaks the law, or breaches our acceptable-use rules, and may respond to valid takedown requests.
3. Acceptable Use
You must not upload unlawful or infringing content; harass or abuse other users; attempt to rip, scrape, or redistribute streams; interfere with the platform’s operation; or misrepresent your identity or your rights to content.
4. Purchases and Subscriptions
Purchases and subscriptions on Esfera are processed by our payment partner Stripe, with Stripe’s Onelink service acting as the merchant of record for the transaction. Your order appears as “Sold through Onelink” at checkout and on your receipt, and your card statement shows a LINK.COM reference. Stripe handles payment processing, applicable taxes, invoicing, subscription emails, and transaction-level support. Your access to Esfera is provided by South Loop Studios Limited under these Terms regardless of the payment channel.
Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time before renewal through your account or through Onelink’s order-management tools; cancellation takes effect at the end of the current billing period. The price and renewal period are shown at checkout, and you will be notified of any price change before it applies to a renewal.
5. Streaming and Availability
Esfera renders spatial audio in the browser and on supported devices. Playback quality depends on your device, connection, and listening environment. We do not guarantee uninterrupted or error-free service and may modify or discontinue features as the platform evolves.
6. Intellectual Property
The Esfera platform — its software, design, and branding — is owned by South Loop Studios Limited. These Terms grant no rights to our trademarks or software beyond the use of the service.
7. Privacy
Our collection and use of personal information is governed by the South Loop Studios Privacy Policy.
8. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential losses, for loss of data, profits, or business interruption, and we do not guarantee uninterrupted, error-free, or secure operation of the platform.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. If you are a consumer, nothing in these Terms affects your statutory rights.
9. Termination
We may suspend or terminate accounts that breach these Terms or where unlawful or abusive use is suspected. You may close your account at any time. On termination your right to use the platform ends; sections relating to intellectual property, liability, and governing law survive.
10. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with a revised date, and we will notify account holders of material changes before they take effect.
11. Governing Law
These Terms are governed by the laws of England and Wales, and disputes shall be subject to the jurisdiction of the courts of England and Wales. If you are a consumer, this does not affect any mandatory consumer protections of the country you live in, and you may also be entitled to bring proceedings in the courts of that country.
